Forever 21 Gets Sued By Its Own Employees

Forever 21 is being sued, though by who may surprise you.

The fast fashion chain’s own employees are taking legal action against the company, who they believe owe them unpaid wages. A class action was suit was filed by one current and four former employees. They claim Forever 21 did not always allow them to take lunch breaks and made them stay after they had already clocked out to undergo mandatory bag checks.

The issue seems to be that the bag checks occurred after, instead of at the end of, employees’ shifts. Don’t bag checks take about a minute? We’re all for fare wages, but not getting paid for a minute-long bag check doesn’t seem to warrant a lawsuit. However, this isn’t the first time the issue of unclocked bag checks got legal attention. A similar (much larger) class action suit involving 6,700 employees was brought against Ralph Lauren in 2010. The company settled for $4 million.

    a bag check takes as long as management makes it take.  if a manager wants to finish counting down a drawer before checking your bag…but makes you clock out–you can be waiting around for a long time.

    but hey, way to support retail workers rights with this excellent article, guys.  really.

    Yes, checking a bag may take a minute, but waiting on a line to get them checked can take quite a bit longer–I don’t work there, but have had to wait on some very long bag-check lines at various events. And, you know, many people out there have to pick up kids from babysitters, schools, etc. or pay overtime charges. And how would you feel about either not getting to take lunch or losing your job? Even if it was a sucky job?

    Wow what an insensitive article. If you’re waiting for a bag check the manager might have to help a long line of customers (as is often the case at many Forever 21 stores) before letting you leave. You have to clock out at the end of your shift on the dot but then obligatorily stay and wait. If this is during closing shift the manager might even decide on a wardrobe change or to use the bathroom. And if there’s more than one employee you have to wait for everyone to grab their things out of lockers, etc. I used to work at Sephora and this same thing happened. There’s also a lawsuit underway for Sephora for this very same reason. If you’re being held inside the store, you need to get paid. Period.

    During closing shifts when I was in college I sometimes missed my bus to go home and would then have to wait an hour for the next one since I went to school in a small town. So no, a bag check DOES NOT take “about a minute” Julia.

    I’m with you Julia.  I’ve worked at places where bags were checked an it never made me late for anything.  The point of a bag check is that you are on the way out of the store.  If you get your bag checked and then go clock out and walk through the store with you bag it defeats the purpose of the bag check.  As far as missed lunches and breaks go, if you’re clocked in and work through your lunch you are getting paid for the time.  Breaks that you do not clock out for are usually at management’s discretion and state laws vary.  Unempoyment is very high and I would love to be working right now, anywhere.

    High unemployment is not an excuse to cheat workers out of wages that they deserve. Even a couple of minutes unpaid work does add up over time-especially if it’s over years.

    Oh jeez, so now it’s okay to roll back the labor laws because people should be so grateful to have a job that they should happily not get lunch hours or be forced to stay at work without pay? Really?

    I was a current employee at forever 21. I worked there for almost 2 years. There is nothing fair about how they treat their employees. The managers had me wait almost 20 minutes to recieve a bag check. After tht it has always been a 10 minute wait. Forever 21 tries to get away with everythig. I worked a 12 hr shift one time . I only took. Two 15 minute breaks and one 30 min break . They made me clock out at 11:59 so they wouldnt have to pay me overtime then made me clock back in at 12:01 because its considered a New day. I went to work at 4pm and didnt get out till 4am and I had class tht morning n I was a full time student in college.
