WATCH: Perez Hilton Does Not Regret Miley Cyrus Upskirt Picture

Perez Hilton has been having quite a week. After tweeting an up-skirt photo of 17-year-old Miley Cyrus, he’s had a lot of explaining to do. Was the photo pixilated or not? Was it a wildly inappropriate example of child pornography or just for fun?

Last night, Perez went on Joy Behar’s show to answer these questions and more. And if you ask us — we’re far from satisfied with his answers. Especially when he insisted, “I don’t regret what I did and I would do the same thing again.”

Has Miley had some questionable fashion choices? Definitely. Do we sometimes wish she’d consult a proper stylist and cover up a bit before leaving her house? Absolutely. But just because a 17-year-old decides to play dress up for the cover of her new CD does not mean she’s asking to have her crotch photographed. In the case of Perez vs. Miley, it seems that he’s the one that Can’t Be Tamed.

I think it’s insulting to children to accuse that of child pornography. If you want to look at the definition of child pornography, it is not an image like the one I posted. It is explicit behavior designed to arouse, engage in sexual activity. You don’t see anything from Miley’s private parts. You just see her from an unflattering vantage view getting out of her car….The — the point is that it’s not child pornography. And if I was aware that it was or that she was not wearing underwear, I would not have posted it. But I — I knew the opposite, Joy. I saw other photos from that video shoot and I was very well aware of the fact that Miley was wearing underwear.

Spare us, Perez. Hanky Panky’s or not, you don’t tweet out a highly suggestive photo — that if you ask us was indeed photoshopped despite the gossip blogger’s denial. Especially when you have over 2 million followers.

I’ve only glanced at Hilton’s site once or twice and other than being envious of his accomplishment, I really have no opinion of the man and I’m not an advocate for child pornography or Miley Cyrus..

With that said, there is no federal law concerning plain-old photographing underage people in a non-sexual manner and most states make an exception for artistic images, news and family photos. The other night, I got into something of a back and forth on another blog, where I linked to this Pulitzer Prize winning, AP image to try and “prove” that simply being naked and underage is not a crime and that was after I had mentioned non-specific gallery exhibitions and Nirvana’s “Nevermind”.

When this initially hit, the first link was to a CBS web story and maybe between all of the confusion in the media, on The View and with Behar, plus the unknowing posts on the blogosphere, we find one of the flaws of not requiring life experience or real world knowledge for those who practice “new media”.
