Today In Irony: Forever21 Is Suing Someone For Copyright Infringement
In what we can only describe as a case of the pot calling the kettle black, fast fashion giant Forever21 is suing Rachel Kane, the blogger behind the website WTForever21.com, who pulls no punches in her criticism of the retail chain’s poor quality and unapologetic copying of designer looks.
Kane told Racked LA that her lawyers and the legal geniuses who keep Forever21 from vaporizing into a black cloud of smoke every day have been firing volleys back and forth at each other for months. In April, they sent her a cease and desist request that accused her of “copyright infringement, trademark infringement, unfair competition and dilution.” We’ll take this opportunity to remind you that everyone from Diane von Furstenberg to Anna Sui has sent Forever21 a letter saying the exact same thing. Finally, after months of just letters, Forever21 issued Kane an ultimatum.
“Forever 21 has responded with a firm threat to file suit unless I take down the blog. I have ten days to decide.”
We’re not lawyers, but we do work with a lot of people with Ivy League-quality law degrees, and from what we can tell Kane doesn’t have everything to worry about. Copyright and trademark infringement laws provide cover for people who use brand names to parody or satirize those brands. And since Kane is basically just making fun of Forever21 (with the occasional compliment thrown in), we don’t think their case would hold up in court. She was even careful enough to post this warning as her site’s opening salvo:
