Christian Louboutin Loses Another Red Sole Lawsuit, This Time To Zara

Christian Louboutin has lost a lawsuit against Zara, and has been ordered to pay $3,600 to the high street retailer. Pennies!

According to Grazia, Louboutin filed a lawsuit against Zara in 2008 claiming Zara sold a pair of slingbacks that were far too similar to a Louboutin design. The Zara version cost around $70, while the Loubs cost nearly $700. Louboutin won the suit, but Zara fired back with an appeal in 2011, citing there was no way that a customer would confuse the two. Now France’s final court of appeal Cour de Cassation has ruled in favor of Zara (ouch) and has fined Louboutin (double ouch).

But Louboutin’s general manager Alexis Mourot tells WWD that the company is not backing down:

“Another red sole trademark application has been successfully registered and we will enforce this trademark against any infringers.”

Of course, this isn’t the first time Louboutin has lost such a lawsuit. If you remember (or still care), the brand is trying to appeal that nasty infringement suit decision against YSL.

    Let Louboutin have its red sole. It is what distinguishes the shoes. It would be so tacky to see another brand have the “logo.” It is a misrepresentation of the Louboutin brand by allowing a cheap shoe such as Zara’s possibly be confused as a Louboutin. I love Zara shoes for what they are, but why use the red sole unless they are trying to mimic the Louboutin look and style and feel?

    Those two shoes are not at all alike. I have a pair of black heels that have a red sole, which I bought without even thinking of Louboutin. To run around putting a patent on a specific-colored sole is just ridiculous. That’s like if I tried to say that no one but myself could make and sell green skirts.

    The thing is that the red sole was not original.  It was around before Louboutin used it and that’s why they lost to YSL.  There are so many designers that have used red soles before, but Louboutin is high end so they try to eliminate competiton through lawsuits.  I think that if Louboutin is confident in their designs, then they should just let others use the red sole.  As for this case with Zara, those shoes look nothing alike.  Courts made the right choice.
